Terms of Service

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

Your continued use of the Service after any changes to these Terms constitutes acceptance of the updated Terms.

You must be at least 16 years old to use the Service if you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, in accordance with the General Data Protection Regulation (GDPR).

If you are located in the United States, you must be at least 13 years old to use the Service, in accordance with the California Consumer Privacy Act (CCPA) and the Children’s Online Privacy Protection Act (COPPA).

In all other jurisdictions, you must meet the minimum age required by applicable local law. You must also have the legal capacity to enter into a binding agreement. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian.

To use certain features of the Service, you must create an account. We currently support account registration through Google OAuth. By registering, you agree that:

• You will maintain only one account per person. Creating multiple accounts may result in termination of all accounts.
• You are responsible for maintaining the security of your account and for all activities that occur under your account.
• You will promptly notify us of any unauthorized use of your account.
• The information you provide during registration is accurate and complete.

The Service allows you to create, upload, and share content including trips, photos, tips, and other materials (“User Content”).

4.1 Ownership

You retain all ownership rights in your User Content. Filledtrip does not claim ownership of any content you submit.

4.2 License Grant

By submitting User Content, you grant Filledtrip a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, modify, and process your User Content solely in connection with operating and improving the Service. This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

4.3 Content Standards

You agree that your User Content will not:

• Violate any applicable law or regulation.
• Be obscene, defamatory, threatening, harassing, or hateful.
• Infringe or misappropriate any third party’s intellectual property or privacy rights.
• Contain malware, spam, or any other harmful or deceptive content.
• Promote illegal activities or violence.

4.4 Content Moderation

We reserve the right to review, moderate, and remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion. We employ automated moderation systems, including AI-based text and image analysis, to help enforce our content standards. Moderation decisions may be appealed by contacting us at legal@filledtrip.com.

You agree not to:

• Scrape, crawl, or use automated means to access the Service without our prior written consent.
• Abuse, disrupt, or overload the Service or its infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Send spam, unsolicited messages, or engage in any form of automated bulk activity.
• Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
• Circumvent any rate limits, security measures, or access restrictions.
• Use the Service for any illegal or unauthorized purpose.

The Service, including its design, code, logos, trademarks, and all associated intellectual property, is owned by Filledtrip and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

As stated in Section 4, you retain ownership of your User Content. Nothing in these Terms transfers ownership of your content to Filledtrip.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data, including your rights under the GDPR and CCPA. Please review it carefully.

The Service integrates with and relies on third-party services, including but not limited to:

• Google — for authentication (OAuth) and related services.
• OpenAI — for AI-powered content processing and recommendations.

These third-party services have their own terms and privacy policies. We are not responsible for the practices of third-party providers. By using the Service, you acknowledge that certain data may be processed by these providers in accordance with their respective terms.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, please be aware that:

• Travel information is user-generated and should not be considered professional travel advice. Always verify information independently before making travel decisions.
• Places may have changed, closed, or moved since the time a user posted about them. We do not guarantee the accuracy, completeness, or timeliness of any location data.
• AI-processed content may contain inaccuracies. Content that has been processed, summarized, or enhanced by artificial intelligence may not be fully accurate. We provide no warranty on the accuracy of AI-generated or AI-processed content.

To the maximum extent permitted by applicable law, Filledtrip and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law.

You may delete your account at any time through the Service’s account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR right to erasure. Some data may be retained as required by law or for legitimate business purposes (such as fraud prevention), as described in our Privacy Policy.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) shall survive.

These Terms shall be governed by and construed in accordance with the laws of France and applicable European Union law, without regard to conflict of law principles.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@filledtrip.com. We will attempt to resolve the dispute within thirty (30) days. If informal resolution fails, either party may pursue legal remedies.

For users in the European Union, you may also lodge a complaint with your local data protection authority or use the EU Online Dispute Resolution platform.

Nothing in this section shall prevent either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service with a new effective date and, where required, by sending you a notification through the Service or via email.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
